These Terms and Conditions (“Terms”) govern your use of https://www.coveryourbrass.com/(the “Site”), scheduling and engagement of professional services, and the purchase of related products provided by Cover Your Brass LLC, a California limited liability company (“Company,” “we,” “us,” or “our”). By accessing the Site, scheduling services, or purchasing products, you agree to these Terms.

2. Scope of Services

The Company provides professional backflow prevention and waterline services, including:

  • Backflow Testing & Certification

  • Backflow Repair & Replacement

  • Backflow Installation

  • Waterline Chlorination & Disinfection

  • Cross Connection Control Surveys

  • Consultation, inspections, and compliance reporting

  • Manufacturing and sale of backflow enclosures and protective cages

Services are performed in accordance with professional standards, applicable licensing, and local code requirements.

Regulatory Determinations:
Inspection results, compliance decisions, and final approvals are determined solely by the applicable water authority. The Company does not control regulatory interpretations or enforcement actions.

3. Commercial Use & Authority

By requesting services or purchasing products, you confirm that:

  • You are at least 18 years old;

  • You are authorized to act on behalf of the property owner or responsible entity.

  • You have the authority to approve work and payment.

Services are primarily intended for property owners, commercial entities, municipalities, contractors, and property management professionals.

4. Scheduling & Payment

  • Services may be requested via the Site, phone, or email. Advance scheduling is not required, though notice helps ensure timely service.

  • Payment is due at the time of service, or as otherwise agreed in writing.

  • Fees for services may change without notice before confirmation.
     

5. Service Conditions & Risk

  • Safe, unobstructed access must be provided to perform services.

  • The Company may decline, suspend, or reschedule services if site conditions are unsafe or inaccessible.

  • Additional service fees may apply for extra labor or return visits.

  • The Company is not responsible for delays caused by weather, natural disasters, labor shortages, supply chain issues affecting equipment, or other events beyond its control.

  • Risk of loss transfers to the customer once services have begun or products are delivered/picked up.
     

6. On-Site Responsibilities

Customers must:

  • Ensure proper installation by authorized personnel or approve the Company installation;

  • Follow local regulations and codes;

  • Provide accurate information regarding equipment, water systems, and property layout.

The Company is not responsible for:

  • Improper installation by third parties;

  • Unauthorized modifications;

  • Use outside the intended purpose;

  • Damages from vandalism, neglect, or environmental factors.
     

7. No Performance Assurances

  • Services are provided according to professional standards.

  • The Company does not guarantee:

    • Regulatory approvals or inspection outcomes;

    • Compliance of systems altered or neglected after service;

    • Functionality of systems outside the Company’s scope.
       

8. Warranty Disclaimer

  • Services and any related products are provided “as is” to the maximum extent permitted by law.

  • Manufacturer warranties may apply to specific components.

  • No oral statements or communications modify these Terms.
     

9. Limitation of Liability

To the maximum extent permitted by California law:

  • The Company shall not be liable for indirect, incidental, special, or consequential damages.

  • Total liability for any claim arising from services or products shall not exceed the fees paid for the affected service or product.
     

10. Indemnification

You agree to indemnify and hold harmless Cover Your Brass LLC from claims arising from:

  • Improper installation by third parties;

  • Unauthorized modifications;

  • Customer-provided measurement or information errors;

  • Misuse of services or products;

  • Violations of applicable laws by the customer.
     

11. Intellectual Property

All content, materials, documentation, service methods, proprietary enclosure designs, and website content are the property of Cover Your Brass. Unauthorized use, reproduction, or distribution is prohibited without written consent.
 

12. User Submissions & Reviews

Customers may submit reviews or feedback based on their personal experience. All content must be truthful and lawful.

The Company may remove submissions that are false, misleading, offensive, or that infringe on third-party rights. By submitting content, you grant Cover Your Brass a license to use it on the Site or in promotional materials.
 

13. Third-Party Services

The Site may use third-party platforms, tools, or payment processors to facilitate payments, communications, or other features. While these services help provide functionality, the Company is not responsible for their policies, practices, reliability, or performance.

By using the Site or making payments, you acknowledge that interactions with these third-party services are subject to the third party’s own terms and privacy policies. The Company is not liable for any issues, errors, or losses arising from the use of third-party platforms or services.
 

14. Existing System Conditions

The Company is not responsible for failures or damages resulting from pre-existing conditions, aging plumbing infrastructure, or previously damaged valves, fittings, or equipment discovered during service.

 

15. Privacy

Use of the Site is governed by the Company’s Privacy Policy, which explains how personal information is collected, used, and protected. By using the Site, you consent to the collection and use of information as described in the Privacy Policy.

The Site and its services are intended for users 18 years or older. Individuals under 18 should not use the Site or provide personal information.
 

16. Force Majeure

The Company is not liable for delays or failure to perform due to:

  • Natural disasters

  • Supply chain disruptions affecting materials

  • Governmental actions

  • Labor shortages

  • Carrier or shipping delays
     

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes, claims, or legal actions arising from or related to these Terms, the Site, or the Company’s services must be brought exclusively in the state or federal courts located in California. By using the Site or engaging our services, you consent to the jurisdiction of these courts.

18. Modifications

The Company reserves the right to update, revise, or modify these Terms at any time, in its sole discretion. Changes will be effective immediately upon posting on the Site. Continued use of the Site, products, or services after such updates constitutes your acceptance of the revised Terms. It is your responsibility to review the Terms periodically for any changes.
